Rules and best practices

OPT OUT rules

According to Comissão Nacional de Proteção de Dados (www.cnpd.pt) opt out apply just for Marketing traffic, and there are two scenarios:

Option 1) Brand/Enterprise sending Marketing text messages to their customer base (already opted in):

No need to include a unsuscribe method because when the suscriber hired a service or signed a contract (by written or electronicaly) , he/she accepted to receive text messages and do the opt out via the brand portal with their the customer credentials..

Option 2) Brand/Enterprise sending Marketing text messages to suscribers over an acquired DB (users non-opted in the brand yet):

Example, a person log in into the airport hot spot accepting terms that include receive promotional messages from third parties. In this case, the brand sending the campaing need to add the URL to allow the opt out, to carry the customer to a landing page and allow the opt out easily.

If brands don´t meet the above rules they can face high fines from CNPD
